Investigation & Prosecution Challenges 

Dr. Frank Kardasz:
For investigators and prosecutors, we have a lot of challenges, besides the fact that, like all of you, we do not have enough staff to work these cases. We know that some of our victims just want the problem to stop. They do not necessarily want to pursue prosecution.

I have had victims that will contact me once and I will never hear from them again because they do not want to be exposed, and I do not blame them. They do not want to necessarily pursue prosecution. They just want the problem to stop.

Sometimes the victims blame themselves. We also have members of the public who want to blame the victims. We always encourage everybody to do a better job of supervising their kids; we know how difficult that is.

For law enforcement and prosecutors, we know that offenders have ever-improving anonymity capabilities. They can use encryption. We have internet service providers who are not cooperating with us sometimes. They do not retain the data that we need.

We are seeing overseas communications, offenders might be overseas; internet service providers might be in another country. So we have a whole other set of legal hoops we have to jump through to send a subpoena overseas. And when the offender is in another jurisdiction or continent, it makes enforcement that much more difficult.
